Arizona Court Vacates Sentence After AI-Generated Victim Video
An Arizona appeals court has vacated Gabriel Paul Horcasitas’ 10.5-year prison sentence and ordered a new sentencing hearing after finding that an AI-generated video of shooting victim Christopher Pelkey made the original proceeding fundamentally unfair. The court upheld the manslaughter conviction; it did not overturn the verdict. Pelkey’s family played a reconstruction made with his likeness and voice during sentencing. The court said the video presented the sister’s interpretation of what Pelkey might have said as if it came directly from him. The sentencing judge had described the video as “genuine” and said it affected his thinking. The opinion does not rule out AI in court generally; it addresses the reliability and due-process problems raised by this video in this case. The decision highlights a difficult boundary for generative AI: a family may speak about a victim’s impact, but a synthetic recreation can make someone else’s words appear to be the deceased person’s own. Horcasitas remains convicted and will be resentenced.
